1. Acceptance of terms

By downloading, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.

We may update these Terms from time to time. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

2. Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you may only use the Service with consent from a parent or legal guardian. By using the Service, you represent that you have the legal capacity to enter into these Terms.

4. The Service and license grant

The Service offers workout tracking; logging of lifts, sets, reps, and weights; progress charts and statistics; AI-assisted workout generation; scheduling; and progress photos.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes. We reserve all rights not expressly granted.

5. No account; importing an older account

Brolift 2.0 has no accounts. You do not sign up or sign in to use the app. Your workouts are stored on your iPhone and, if you use iCloud, in your private iCloud database, which belongs to your Apple Account. You are responsible for keeping your iPhone and your Apple Account secure.

If you used an earlier version of Brolift, you can import your older account from the Dashboard (“Used Brolift before?”) or from Settings › Account › Import Old Account. To do this, you sign in to that account with Sign in with Apple or Google Sign-In. You are responsible for keeping those sign-in credentials secure.

Notify us promptly at support@brolift.app if you suspect unauthorized use of your older account. We may suspend or terminate access as described in section 15.

6. AI-generated content

The Service uses AI (Apple Intelligence, running on your iPhone) to generate and suggest workouts from a description you type. It is available only on iPhones that support Apple Intelligence.

• AI output may be inaccurate, incomplete, or unsuitable for your situation. It is not professional, medical, or personalized training advice. See section 3.
• You are responsible for using judgment about whether to follow any AI-generated suggestion.
• We make no guarantee that you will achieve any specific fitness result from using the Service.

7. User content and conduct

Your content

You retain ownership of the content you add to the Service, including progress photos and videos, workout data, measurements, and profile information. In Brolift 2.0 this content is stored on your iPhone and, if you use iCloud, in your private iCloud database, and we do not receive a copy. For content we do hold, such as data in an older Brolift account, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit that content as needed to operate the Service, including copying it to your iPhone and iCloud when you import it.

Acceptable use

Brolift 2.0 has no social features, and nothing you add in the app is shared with other people or uploaded to us. You agree not to reverse-engineer, decompile, or interfere with the Service, try to bypass its security, or use it to break the law.

We may delete content on our legacy servers that breaks the law or these Terms.

8. Subscriptions, purchases, and payments

Brolift is currently free to use. We may introduce paid features in the future. If we do, pricing, billing, renewal, free trials, and cancellation terms will be presented at the point of purchase and through the Apple App Store subscription system.

Purchases made through Apple are processed by Apple and are governed by its terms; refunds follow its policies. You can manage and cancel subscriptions in your App Store account settings.

9. Intellectual property

The Service, the “Brolift” name and logo, the app design, source code, and all related materials are owned by POWERUP GAMING LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.

10. Third-party services

The Service depends on third-party providers, mainly Apple (iCloud, Apple Health and Apple Intelligence). In the app, Google (Google Sign-In and Firebase) is used only to import an older Brolift account. The website is hosted on Google Firebase Hosting. The Service may also link to third-party content. We are not responsible for those services and their terms apply when you use them. Your use of the app on your iPhone is also subject to the App Store EULA.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect, how we use it, and your choices.

12. Disclaimers of warranty

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not guarantee that your data will not be lost. Keep iCloud turned on so Brolift can back up your workouts; Brolift has no export feature.

13. Limitation of liability

To the maximum extent permitted by law, POWERUP GAMING LLC and its owners, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages, or for personal injury (see section 3), lost profits, or loss of data, arising out of or related to your use of the Service.

In any event, our aggregate liability arising out of or related to the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim or (b) one hundred U.S. dollars (US$100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless POWERUP GAMING LLC and its owners, employees, and agents from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of your use of the Service, the content you upload, or your breach of these Terms.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we otherwise decide to discontinue providing the Service to you.

You may stop using the Service at any time. To delete your Brolift data, open Settings › Account › Backup & Storage in the app and choose Delete iCloud Data (Delete All Data if iCloud is not syncing); with iCloud, this deletes it from every device signed in to that Apple Account. To have an older Brolift account and its data deleted, email support@brolift.app, as described in our Privacy Policy.

Sections covering intellectual property, disclaimers, limitation of liability, indemnification, governing law, and any other provisions that by their nature should survive will survive termination.

16. Changes to the Service and these Terms

We may modify or discontinue features of the Service at any time. We may also update these Terms; material changes will be communicated in the app or on this site. Continued use after changes become effective constitutes acceptance.

17. Governing law and dispute resolution

These Terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict of laws rules.

Before filing a formal claim, you agree to first contact us at support@brolift.app and attempt informal resolution for at least 30 days. Any unresolved dispute will be brought exclusively in the state or federal courts located in Rutherford County, Tennessee, and you consent to the personal jurisdiction of those courts.

Class-action waiver: you and POWERUP GAMING LLC agree to bring claims only on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding.

18. Apple App Store

For users who download the Service through the Apple App Store, the following also applies:

• These Terms are between you and POWERUP GAMING LLC, not Apple.
• Apple is not responsible for the Service or any support related to it.
• Apple is a third-party beneficiary of these Terms and may enforce them against you as a user of the Service.
• You agree to comply with the App Store Terms of Service in addition to these Terms.

19. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms; we may assign them to a successor in connection with a merger or sale of assets. Neither party is liable for delays caused by events outside its reasonable control (force majeure).
